1. Who we are

Verified ATX ("Verified ATX," "we," "us") provides independent architectural review (ARC/ACC) consulting to developers, homeowners associations, builders, and homeowners in Texas. This policy explains how we handle personal information collected through verifiedatx.com (the "Site") and when you contact us by email or phone. We are responsible for the information described here.

2. Information we collect

Information you give us

When you use our contact form or email or call us, we collect what you provide, such as your name, email address, phone number, your role (for example, developer, HOA board member, or homeowner), the community or project you're asking about, and the contents of your message and any files you send.

Information collected automatically

Like virtually every website, our hosting provider automatically records basic technical information when you visit, such as your IP address, browser type, the pages requested, the referring page, and the date and time. These logs are used to deliver, secure, and troubleshoot the Site. We do not use this information to identify you or build a profile of you.

What we don't collect

The Site does not use cookies, analytics tools, advertising pixels, or social media trackers. We do not knowingly collect sensitive personal data (such as Social Security numbers, financial account numbers, health information, or precise geolocation), and we ask that you not send it through the Site.

3. How we use your information

• To respond to your inquiry and communicate with you.
• To evaluate, propose, and provide our consulting services.
• To keep business records such as correspondence, engagements, and invoices.
• To operate, secure, and protect the Site and prevent spam and abuse.
• To comply with legal obligations and enforce our agreements.

We will not use your information for purposes that are materially different from these without telling you first and, where required, getting your consent. We do not use your information for targeted advertising or automated decision-making that produces legal or similarly significant effects.

4. How we share information

We do not sell your personal information, and we do not share it for targeted advertising. We share it only as follows:

• Service providers that help us run our business and are allowed to use the information only on our behalf. For example, Netlify hosts the Site and receives contact form submissions, and our email provider delivers and stores our email. These providers are located in the United States.
• Professional advisors, such as attorneys and accountants, when reasonably necessary.
• Legal requirements. When required by law, subpoena, or court order, or to protect the rights, property, or safety of Verified ATX, our clients, or others.
• Business transfers. If our business is sold, merged, or reorganized, information may transfer to the successor, subject to this policy.
• With your direction. For example, sharing a review or recommendation with an HOA board or management company as part of work you engaged us to do.

5. Client and project materials

Plans, applications, governing documents, and other materials we receive while performing services are handled under our engagement agreement with the client, and in accordance with the community's governing documents and applicable law. This policy covers personal information collected through the Site and general business communications.

6. How long we keep information

We keep personal information only as long as reasonably necessary for the purposes described above, including to respond to you, provide services, maintain business records, and meet legal, tax, or accounting requirements. Inquiries that do not lead to an engagement are periodically deleted. Hosting logs are kept by our provider for a limited period under its own retention practices.

7. How we protect information

We use reasonable administrative, technical, and physical safeguards appropriate to the information we hold. The Site is served only over encrypted HTTPS connections, and access to form submissions and email is limited to people who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Your choices and rights

Wherever you live, you may ask us to:

• confirm whether we process your personal information and give you a copy of it;
• correct inaccurate information;
• delete information you provided or that we hold about you; and
• stop sending you communications.

Because we do not sell personal information, use it for targeted advertising, or profile you, there is nothing to opt out of in those categories.

How to make a request. Email ryan@verifiedatx.com with the subject line "Privacy request," or call 512.997.8830. We may need to verify your identity before acting on a request. We will respond within 45 days, and will let you know if we need more time where the law allows it. We will not discriminate against you for exercising these rights.

Appeals. If we decline your request, you may appeal by replying to our decision with the subject line "Privacy appeal." We will respond to appeals within 60 days. If you are a Texas resident and are not satisfied with the outcome, you may contact the Texas Attorney General.

9. Do Not Track and Global Privacy Control

Because the Site does not track visitors across websites or over time, it behaves the same whether or not your browser sends a Do Not Track or Global Privacy Control signal.

10. Children

The Site is intended for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has sent us information, contact us and we will delete it.

11. Links to other websites

The Site may link to websites we don't control. Their privacy practices are governed by their own policies, not this one.

12. Changes to this policy

We may update this policy from time to time. When we do, we'll post the new version here and change the effective date above. If we make material changes to how we use personal information, we'll give more prominent notice before the change takes effect.
